1. Acceptance of Terms
ComplyandTrack ("the Service") is operated by Johann David Ong, a sole proprietor trading as "ComplyandTrack" ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
ComplyandTrack helps licensed professionals track license renewals, continuing education (CE) hours, and related compliance records. The Service is provided on an "as is" and "as available" basis.
3. Accounts and Eligibility
You must be at least 18 years old and provide accurate information. You are responsible for safeguarding your password and for all activity under your account. Notify us immediately of any unauthorized use.
4. Your Data
You retain ownership of all data you upload, including license records and CE information. You grant us a limited license to process this data solely to operate and improve the Service. See our Privacy Policy for details.
5. Acceptable Use
You agree not to:
- Use the Service for unlawful purposes or to infringe others' rights;
- Upload malware, attempt to breach security, or reverse engineer the Service;
- Resell or sublicense the Service without written permission;
- Submit false or misleading compliance records.
6. Subscription and Billing
Paid plans are billed in advance on a recurring basis. You authorize us (through our payment processor) to charge your payment method until you cancel. Refunds are governed by our Refund Policy.
Our order process is conducted by our online reseller Paddle.com Market Limited ("Paddle"). Paddle is the Merchant of Record for all our orders. Paddle provides all customer service inquiries relating to billing and handles returns. Paddle will appear on your bank or card statement as the entity charging you. Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms.
7. No Professional Advice
ComplyandTrack is a record-keeping tool. It does not provide legal, regulatory, or professional advice, and reminders are provided as a convenience. You remain solely responsible for meeting your licensing and CE obligations.
8. Disclaimer of Warranties
To the maximum extent permitted by law, the Service is provided without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
9. Limitation of Liability
To the maximum extent permitted by law, ComplyandTrack and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, including missed deadlines, lost licensure, lost profits, or lost data. Our total liability for any claim is limited to the amount you paid us in the twelve months preceding the claim.
10. Termination
You may cancel at any time from your account settings. We may suspend or terminate accounts that violate these Terms. Upon termination, your right to use the Service ends immediately.
11. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated by email or in-app notice. Continued use of the Service constitutes acceptance of the updated Terms.
